A former legal adviser to controversial businessman Zunaid Moti has been released after the Lundberg Magistrate’s Court suspended his arrest warrant.
Clinton van Niekerk was arrested in Durban on Wednesday for “theft of classified information,” lawyer Stephen May said.
He was en route to New Zealand at the time of his arrest, apparently out of fear for his life.
According to the indictment, he allegedly stole 4,013 files of classified information from Moti Group between September and November 2022.
Moti owns the Sandton-based Moti Group. Moti Group has business interests in mining, property development, security, logistics and aviation.
Van Niekerk was transferred from Durban to Johannesburg, but his legal team successfully stopped the transfer to the High Court of KwaZulu-Natal in Durban.

The High Court issued an order on Thursday directing the Minister of Security and Security and the station masters of Verulam and Sandton SAPS not to remove Van Niekerk from the jurisdiction of the Verulam Magistrate’s Court or the jurisdiction of KwaZulu-Natal. The court also ordered Van Niekerk to be detained at Verulam Police Station, pending his application to revoke the Gauteng warrant.
The court ordered that ministers and commanders be notified of the order by telephone and arranged for the order to be transmitted electronically.
During proceedings at Lundberg Magistrates Court on Friday, May said police had taken clients to Gauteng after being arrested in Durban in violation of a court order, and they were accused of insulting the court. claimed to be
