A Midwest real estate agent isn’t ready to give up fighting his own party after allegations of defamation were filed while running for state legislature.
According to News Channel Nebraska, real estate agent Janet Palmtag is seeking to dismiss a defamation lawsuit filed against the Nebraska Republican Party. A judge ruled in favor of her party last month.
The issue dates back to 2020, when Palmtag ran for the Nebraska legislature. The state’s Republican Party endorsed another candidate, issuing mailers claiming she had “broken the law” and “lost” her real estate license.
The judge upheld Palmtag’s contention that the allegations were technically false. However, the judge also ruled that he should not proceed with the case because “actual malice” was not shown. This is a high hurdle to achieve.
According to the judge, the word “canceled” regarding Palmtag’s license posted on the Iowa Real Estate Commission’s website could be construed as “lost,” and the mailer said: I’m here.
In addition, the party’s secretary general in the province claimed that Palmtag had received the lawsuit from the commission, but in fact opposed someone under her supervision.
According to the Nebraska Examiner, Palmtag gave up her real estate license in Iowa, but claimed it was due to reduced business in Iowa rather than a disciplinary action like the mailman had alluded to.
Palmtag said her real estate business took a hit as a result of her false statements, and claimed her property listings had since fallen. In 2019, she was averaging 20 listings per year, according to Palmtag, in 2020 she had 7 and in 2021 she had 12.
Her website currently shows only 4 listings in Nebraska. Her Palmtag, former president of the Nebraska Realtors Association and named 2016 Nebraska Realtor of the Year, also holds her license in Missouri.
As for Palmtag’s political future, polling records show that she switched party affiliations to the Democratic Party, according to the examiner.
